1.1 These terms and conditions of sale (“Terms”) apply to all sales of goods by Disc Golf Aotearoa Limited (“Seller”) to any person (“Buyer”) and form the entire agreement between the parties.\u00a0<\/span><\/p>\n 1.2 By placing an order with Disc Golf Aotearoa Limited, the Buyer agrees to be bound by these Terms.<\/span><\/p>\n 2.1 All orders are subject to acceptance by Disc Golf Aotearoa Limited.\u00a0<\/span><\/p>\n 2.2 Disc Golf Aotearoa Limited reserves the right to refuse any order or cancel any order previously accepted by Disc Golf Aotearoa Limited at any time, for any reason.\u00a0<\/span><\/p>\n 2.3 The Buyer must ensure that all details provided to Disc Golf Aotearoa Limited when placing an order are accurate and complete.\u00a0<\/span><\/p>\n 2.4 Disc Golf Aotearoa Limited will confirm acceptance of the order in writing.<\/span><\/p>\n 3.1 All prices are quoted in the currency of the Buyer’s location, as determined by Disc Golf Aotearoa Limited’s website.\u00a0<\/span><\/p>\n 3.2 Prices are subject to change at any time without notice.\u00a0<\/span><\/p>\n 3.3 Payment is required at the time of placing an order unless you have a written agreement for longer payment terms.\u00a0<\/span><\/p>\n 3.4 Payment can be made by credit card or direct bank transfer.\u00a0<\/span><\/p>\n 3.5 If the Buyer fails to make payment when due, Disc Golf Aotearoa Limited may cancel the order and charge a cancellation fee of 10% of the total order value.\u00a0<\/span><\/p>\n 3.6 Disc Golf Aotearoa Limited may offer different discount structures for bulk purchases, subject to minimum quantity requirements. These discounts will be clearly stated on Disc Golf Aotearoa Limited’s website or in any written quotation provided to the Buyer.<\/span><\/p>\n 4.1 Delivery times are estimates only and Disc Golf Aotearoa Limited will not be liable for any delay in delivery.\u00a0<\/span><\/p>\n 4.2 The Buyer is responsible for providing a valid delivery address.\u00a0<\/span><\/p>\n 4.3 The risk of loss or damage to the goods passes to the Buyer upon delivery. 4.4 If the Buyer wishes to return any goods, they must do so within 7 days of receipt and in accordance with Disc Golf Aotearoa Limited’s returns policy.<\/span><\/p>\n 5.1 The Consumer Guarantees Act 1993 applies to the sale of goods by Disc Golf Aotearoa Limited to the Buyer.\u00a0<\/span><\/p>\n 5.2 Nothing in these Terms limits or affects any rights the Buyer may have under the Consumer Guarantees Act 1993.<\/span><\/p>\n Liability and Indemnity\u00a0<\/span><\/p>\n 6.1 To the fullest extent permitted by law, Disc Golf Aotearoa Limited excludes all liability to the Buyer for any loss or damage (including indirect or consequential loss or damage) arising from any breach of these Terms or otherwise.\u00a0<\/span><\/p>\n 6.2 The Buyer indemnifies Disc Golf Aotearoa Limited against any claim, demand, or liability, including legal fees, made by any third party due to or arising out of the Buyer’s breach of these Terms or any applicable law.<\/span><\/p>\n 7.1 These Terms are governed by the laws of New Zealand.\u00a0<\/span><\/p>\n 7.2 The parties submit to the non-exclusive jurisdiction of the New Zealand courts.<\/span><\/p>\nOrders and Acceptance\u00a0<\/span><\/h3>\n
